Company Mission: finalshot.com is dedicated to providing the public with the absolute finest in photographs at reasonable prices and to putting those photos in our customer’s hands in mint condition as quickly as possible. To that end, we have purchased the very best and latest cameras, lenses, and other equipment available to accomplish our mission.

Web Site Mission: Provide highly accurate images of our photos on a web site that is simple to use and as quick to operate as is possible. Production of photos will vary slightly in color and cropping from one production run to the next. It is our goal to keep that variation to an absolute minimum so that what you see is what you get.

Photographs: Our photos are either taken by our own photographers or by other photographers that we know personally. All photos are copyrighted by the original photographer, and as such, it is illegal for anyone to reproduce those photos without the photographer’s written consent.

The products sold on finalshot.com are not licensed or endorsed by any professional sports league, any professional sports team, any player's association, or any player from said league or player's association. Leagues mentioned above may include but are not limited to: The NBA, the NFL, the NHL, MLB, NASCAR, the WNBA, the WBA, or the PGA.

Photo Returns: We must be notified of any damaged photos within 3 business days of their receipt by our customer fax (847-991-7706), or email Jeff@finalshot.com. You, the customer, must then return the photos to us within 10 days of receiving them. The photos must be returned in the same condition they were shipped, and must be properly packaged to avoid in transit damage. You, the customer, are responsible for any damage that occurs during the return. Finalshot.com recommends you insure the returned items for their full purchase price. A Finalshot.com employee will then inspect the photos and replace any defective photos. We guarantee all photos will be as accurately displayed as possible on our web page. Any of our photographs that you are not happy with will be replaced with any photo you choose of equal cost, provided the photographs are returned undamaged and without finger prints. The customer will be responsible for any repackaging or reshipping costs for undamaged photo replacements. If you would prefer a refund on a photo you just don't like, there is a 25% restocking fee. There will be no refunds for special order photos or for shipping and packing charges. No return will be accepted without prior notice that a return is being made.

Order Processing and Shipping: It is the customer’s responsibility to use Finalshot.com photo numbers as displayed above every thumbnail on our website to facilitate the accurate filling of an order. We generally ship by UPS, and all shipments are FOB Seller’s warehouse. We will ship by whatever method (Next Day Air, Second Day Air, Ground, etc.) you request and pay for. It is also the customer’s responsibility to put a need-by date on every order submitted so that finalshot.com knows when it has to be shipped. As long as we ship the order within a reasonable amount of time for it to be delivered, Finalshot.com cannot be held responsible for UPS’s failure to deliver on time. It is the customer’s responsibility to order with enough lead time to cover UPS delivery delays. Finalshot.com and its employees are not responsible for any damages that result from a carrier’s late delivery.

Minimum Purchases: Wholesale purchases require a minimum purchase of $100.00 in photos. We may from time to time accept smaller orders, but we reserve the right to put a small surcharge on the packing fee if a customer continually purchases less than the minimum.

Amendments: Finalshot.com reserves the right to amend these policies at any time. Finalshot.com shall not be required to give notice of the amendments other than by posting the amended policies on the finalshot.com website. Orders are subject to the policies in place at the time the orders are placed. Finalshot.com will put the date the policy was revised on finalshot.com’s home page behind the "Sales & Return Policy" link on our home page.

General: In the event of any non-payment by Client, Client is responsible for all costs of collection incurred by FinalShot.com in attempting to collect any sums due. Such costs include but are not limited to court costs and reasonable attorneys' fees, costs, and expenses.

FINALSHOT.COM MAKES NO WARRANTY AS TO MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. FINALSHOT.COM DISCLAIMS AND SHALL NOT BE LIABLE FOR, AND CUSTOMER WAIVES, ANY CLAIMS OR REMEDIES CUSTOMER MAY HAVE AGAINST FINALSHOT.COM FOR DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES OF CUSTOMER OR ANY THIRD PARTY, INCLUDING BUT NOT LIMITED TO DAMAGE ARISING FROM LOST PROFITS, CUSTOMER CLAIMS, LOSS OF USE OF ANY OR ALL WORK PRODUCT, LACK OR LOSS OF PRODUCTIVITY, INTEREST CHARGES, OR COST OF CAPITAL, WHICH ARISE OUT OF ANY BREACH OF THIS AGREEMENT BY FINALSHOT.COM OR ANY OBLIGATIONS FINALSHOT.COM OWED TO CUSTOMER OR FINALSHOT.COM’S BREACH OF WARRANTY, OR WHICH ARISE PURSUANT TO ANY TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY, BUT EXCLUDING GROSS NEGLIGENCE OR WILLFUL MISCONDUCT) OR OTHER CLAIM, OR FOR ANY CLAIM MADE AGAINST CUSTOMER BY ANY OTHER PARTY, EVEN IF FINALSHOT.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH CLAIM IN ADVANCE, EXCEPT AS SPECIFICALLY PROVIDED IN THIS PARAGRAPH. FINALSHOT.COM’S TOTAL LIABILITY AND CUSTOMER’S SOLE AND EXCLUSIVE REMEDY FOR LOSS OR DAMAGES RELATING TO OR ARISING OUT OF THE PERFORMANCE OF FINALSHOT.COM UNDER THIS AGREEMENT AND/OR ARISING UNDER ANY THEORY AT LAW OR EQUITY (WHETHER TORT, NEGLIGENCE OR OTHERWISE) IS LIMITED TO AND SHALL NOT EXCEED THE AMOUNT CUSTOMER PAID TO FINALSHOT.COM FOR THE PRODUCTS ORDERED. EXCEPT AS THIS PARAGRAPH EXPLICITLY PROVIDES, CUSTOMER SPECIFICALLY WAIVES ALL OTHER REMEDIES AVAILABLE TO IT AT LAW, IN EQUITY OR OTHERWISE, WHETHER FOR BREACH OF CONTRACT, TORT, OR OTHERWISE.
